Zhuchenko Y. Criminological characteristics and prevention of criminal offenses in the field of road traffic safety

A comprehensive criminological study of criminal offenses in the field of road traffic safety as a negative social and legal phenomenon has been carried out in the dissertation. A detailed criminological description of such an illegal act has been compiled, and a system of measures and means of criminal offenses prevention in the field of road traffic safety in Ukraine has been developed on this basis. It is claimed that criminal offenses in the field of road traffic safety as a socially dangerous phenomenon, as well as measures to prevent such acts became the subject of many scientific studies by domestic and foreign scientists. It is noted that to date the following problems remain unexplored or not fully investigated: 1) correlation between administrative-legal and criminal-legal limits of responsibility for violation of road traffic safety rules; 2) peculiarities of the mechanism of criminally illegal behavior of the subject of a criminal offense in the field of road safety; 3) victimological characteristics and the role of the victim in the mechanism of a criminal offense in the field of road traffic safety; 4) definition of a modern deterministic complex (in particular, considering special legal regime of martial law), which affects the quantitative and negative change in the qualitative indicator of criminal illegal activity in the field of road traffic safety; 5) establishing the identity of a criminal offender who commits a socially dangerous act in the field of road traffic safety, depending on the mechanism of his\her criminally illegal behavior; 6) update of strategic documents aimed at solving the problem of three-level prevention of criminal offenses in the field of road traffic safety; 7) features of integration into national practice of positive international and foreign experience in regulating relations in the field of road traffic safety. A system of measures for victimological prevention of criminal offenses in the field of road traffic safety has been developed and differentiated for different types of victims: driver victims, pedestrian victims and other road users, as well as passenger victims.
