Kuzyk V. Legal regulation of membership relations in non-entrepreneurial societies.

The object of the study is social relations, which are formed during the legal regulation of membership relations in non-entrepreneurial societies. The purpose of the research is to determine the specifics of membership relations in non-entrepreneurial societies, as well as to develop scientific conclusions and practical recommendations regarding the improvement of current civil legislation in the sphere of regulating membership relations in non-entrepreneurial societies. The use of scientific methods in the dissertation is determined by the specifics of the goal, set tasks and object of research. The work uses both general scientific and special scientific methods of scientific knowledge. For example, through using the system method and the method of analysis, the question of the place of membership relations in the system of civil legal relations, as well as their internal structure, was investigated. With the help of dogmatic and formal-legal methods, the quality and state of regulatory regulation of membership relations in non-entrepreneurial societies was revealed. The dialectical method provided a comprehensive analysis of the legal nature and structure of membership relations in non-entrepreneurial societies. The forecasting method was used in the formulation of proposals and recommendations for improving the current civil legislation regarding membership relations in non-entrepreneurial societies. The scientific novelty of the obtained results is due to the fact that as a result of the research, the following propositions, conclusions and proposals, which possess scientific novelty, were formulated, in particular: a set of factors that determine the institution of membership in non-entrepreneurial societies was determined: 1) heterogeneity of membership, which is manifested in the list of rights of members various types of non-entrepreneurial societies; 2) various interests - non-property and consumer interests of a property nature with which members of a non-entrepreneurial society enter into it; 3) membership in non-entrepreneurial societies is determined by the formula "not to receive more than invested";the degree of completeness of rights in relation to the company has an absolute manifestation in the content of corporate rights as a set of property and non-property rights of the participants of entrepreneurial companies, and also in abbreviated form presented in membership rights as a set of non-property and separate property rights, which are determined by the consumer and investment interest of membership, which, however , implemented within the framework of a non-entrepreneurial society; the proposition that the main difference in the exercise of corporate and membership rights is manifested in the principle of proportionality of rights in accordance with the size of the share in the authorized capital of a business company and the principle of equality of rights of members of non-business companies is argued;two types of obligations of a member of a non-entrepreneurial society are defined: the first is related to the payment of membership fees of an obligatory and legal nature; the second - in compliance with the requirements of the statute which corresponds to the set of non-property rights of a member of a non-entrepreneurial society.
