Spyrydonova K. Arbitrability of Disputes in International Commercial Arbitration

The dissertation is devoted to complex and thorough research of the issue of disputes arbitrability under the laws of Ukraine and foreign countries. The provisions formulated according to the results of the research contain elements of scientific novelty and have prospects for further practical application. The dissertation research made it possible to conduct a comprehensive analysis of the complex and multidimensional concept of "arbitrability", which, despite the rapid popularization, has not yet become the subject of dissertation research. The present paper defines the concept of "arbitrability" as compliance of the matter of the dispute and its subjects with certain requirements which allows to to conclude arbitration agreement and transfer such dispute for consideration to international commercial arbitration. At the same time, it is proposed to consider arbitrability as a legal concept that combines objective and subjective arbitrability. The article identifies such features of arbitrability as «international nature», private legal nature, variability depending on the chosen legislation, combination of objective and subjective elements.
