The dissertation is devoted to a comprehensive theoretical study and improvement of the theoretical foundations and practice of legal regulation of budget expenditures on national security and defense. Budget expenditures on national security and defense are a significant component of Ukraine's financial system. With the beginning of the Russian invasion, the conditions related to the filling of the State Budget of Ukraine and local budgets, and, accordingly, to the formation of expenditures, have changed. Ensuring proper financing of the national security and defense sector is an urgent problem at the current stage of state formation that requires immediate solution, and control over budget expenditures on national security and defense of Ukraine is recognized as one of the main priorities. The dissertation examines the essence and peculiarities of legal regulation of budget expenditures on national security and defense, and identifies their impact on the country's economy, defense capability, and security of the State and society. It is substantiated that ensuring an adequate level of financing of the national security and defense sector is an important component for the effective functioning and protection of the State. It is found that the source of resources for the implementation of such priority functions of the State as ensuring national security and defense is the funds of the State Budget of Ukraine and local budgets. The author examines various scientific approaches to the interpretation of the terms «budget», «budget expenditures», «national security», «defense»; the author formulates his own definitions of the concepts of «budget expenditures», «budget expenditures for national security», «budget expenditures for national defense». The author examines such functions of the State as defense and national security, the essence of which is to ensure the protection of territorial integrity, sovereignty, national interests and security of citizens from potential threats, including armed aggression and armed conflict, and to guarantee the security of national interests in the event of negative trends that may pose potential or real threats to national values in various areas, respectively. The author reveals the approaches to understanding the concepts of «national security system» and «system of ensuring national security». The author establishes that the role of the national security system in the legal support of the State's financial security is significant in that it is aimed at identifying and overcoming various factors which may pose a threat to the national interests of the State and its citizens. However, the concept of «national security system» does not have a clear legal definition, and, accordingly, is not reflected in the current legislation of Ukraine. The author identifies the main structural elements in the national security system of the country and characterizes the subsystem of the national security system - the «national security and defense sector», which is understood as a complex of authorized state bodies, local self-government bodies and public organizations engaged in ensuring security and protection of the national interests of the State.
