Essay

The dissertation highlights the existing theoretical approaches, the role of publications, and scientific research that directly or indirectly illuminate the essence of self-regulation in online civil relationships. The study underscores the significance of self-regulation as a pivotal instrument for impacting modern society and the legal sphere, particularly within the online domain. It unveils the potential for all stakeholders to participate in shaping legal norms and fostering a more effective and adaptable regulatory framework across various domains of activity. A research approach to considering self-regulation as a concept allows us to understand that it is not just a system of legal norms, but also a complex mechanism that influences all spheres of social life. The dissertation defines the characteristics that self-regulation must possess to be acknowledged as a legal source. These characteristics encompass the importance of alignment with universally accepted values, the presence of structured procedures and mechanisms for self-regulation, along with the capacity to ensure the implementation of accepted norms, a formal definition, mandatory nature, government or other authorized entities' oversight and enforcement, etc. The dissertation constitutes a significant contribution to comprehending and employing self-regulation as a source of law and a means of social regulation holistically. It opens up novel prospects for addressing contemporary social and legal challenges in the context of rapid technological advancement, thereby promoting greater efficiency and flexibility within this process.
