The dissertation represents the first comprehensive study within Ukrainian doctrine of intellectual property law focusing on judicial jurisdiction in the field of industrial property rights protection, contextualized through an examination of theoretical and practical legal experiences in Ukraine and European Union countries. The research of the dissertation is based on a comprehensive approach to the issues of judicial jurisdiction and the specifics of the industrial property institution in Ukraine, as well as in the legal practices of EU states, utilizing specialized and interdisciplinary scientific methods. A key aspect of the research structure is a persistent focus on harmoniously combining diverse methods and approaches within the scientific research toolkit. The dissertation establishes a conceptual framework for justifying the philosophical and legal principles of industrial property rights protection as an integral component of the legal foundation ensuring technological and economic order and contributing to the societal legal culture. The focus is on enduring principles of the value-based legal nature of judicial protection and legal safeguarding of intellectual labor results, receiving legal protection based on norms in industrial property and human rights legislation concerning access to judicial protection and derivative rights of intellectual property rights holders, as well as constitutional provisions and specific laws governing justice delivery in Ukraine and the European Union within a unified European legal framework through the operation of international legal instruments in intellectual property law.
