The dissertation is devoted to a scientific and legal analysis of administrative and legal support for the protection of social rights of servicemen and their families in Ukraine, identification of gaps and shortcomings in the field of administrative and legal support for the protection of social rights of servicemen and their families, development of proposals for improving legislation in this area and ways of practical implementation of the results achieved in the study.
The dissertation study consists of three chapters.
The first chapter examines the theoretical and legal framework of administrative and legal regulation of the protection of social rights of servicemen and their family members.
The author establishes that an integral element of the administrative and legal status of servicemen is their social rights, which the State is obliged to properly protect through its administrative and legal activities.
The author proves that the State guarantees of social rights of servicemen and members of their families in the context of reforming the Armed Forces of Ukraine are a guarantee of stability, security, safety and guarantee, and require updating (modernisation) and proper legislative consolidation, and introduction of an effective administrative and legal regulatory mechanism.
The administrative and legal doctrine defines the following terms: the institute of administrative and legal protection of servicemen and their family members, the social and legal status of servicemen and their family members, the State guarantees of the rights of servicemen, war veterans and their status, family members of servicemen, and administrative and legal protection of social rights of servicemen and their family members.
Based on the scientific and theoretical research of national scholars, the author substantiates and formulates for the first time the concept of the institute of administrative and legal support for the protection of social rights of servicemen and members of their families.
The institute of administrative and legal support for the protection of social rights of servicemen and their families is a complex and multifaceted concept that is constantly evolving and consists of components aimed at ensuring and protecting the constitutional rights and freedoms of this category of citizens. It includes a wide range of components: social protection, social security, social work, social support, social assistance and legal protection.
The basis of this institution is social protection, which defines the norms that ensure the implementation of special social benefits, guarantees and compensations to meet the material and spiritual needs of servicemen and their families in accordance with their special type of activity and supports their status in society.
Social security includes measures to redistribute state budget funds to provide financial support to servicemen and their families, aimed at compensating, reducing or preventing the negative impact of social risks arising from the specifics of their service activities.
Within the framework of this institution, social work is carried out, which consists of providing qualified assistance to servicemen and their families in order to support their social functioning, promoting the exercise of civil rights and creating social conditions for improving the quality of life of individual servicemen and increasing the well-being of their families.
Social support in the armed forces should be described as a type of social support for servicemen and their families, which includes the provision of a range of social services to a specific individual or family.
Social support in the armed forces should be viewed as actions aimed at building resilience of servicemen and women as individuals, families and communities in order to strengthen their potential for recovery and adaptation. Social support can be material, emotional, informational and instrumental. Material support includes the provision of material goods.
An important component of the institute of administrative and legal protection of social rights of servicemen is their legal protection, which should be considered as the organisation of free legal aid to servicemen and members of their families for the purpose of realisation and protection of their legal rights and interests, which includes advisory, explanatory, legal education activities, assistance in collecting and drafting legal documents and representation of interests in case of violation of legal rights and interests.
