Hres N. Mediation as a method of resolving individual labor disputes

During the research, it was proved that guarantees of the right to a fair resolution of the dispute could not be ensured only by the judicial system. It was found that the main shortcomings are the busyness of the courts, the length and complexity of the judicial process, the prolongation of the consideration of cases terms, additional costs for legal assistance, disclosure of the information, etc. The lack of an extensive and effective system for resolving individual labor disputes at every enterprise, institution, and organization remains a problem that requires an urgent solution. The level of professional training, the competence of the commission’s members on labor disputes, their objectivity, readiness to effectively resolve disputes raise questions. The consequences of the martial law in Ukraine, in addition to the general negative impact on the economy and social and labor relations in Ukraine, encourage the search for alternative and effective dispute resolution mechanisms, among which a special place is occupied by mediation, which does not replace the judicial process, creates additional opportunities for the participants in the dispute, increases their role, importance, and mutual responsibility.
