Bilchuk O. Administrative and legal support for the implementation of state policy in the field of enforcement of court decisions and decisions of other bodies

The dissertation became one of the first in the science of administrative law of complex studies of increasing the effectiveness of the formation and development of state policy in the field of administrative and legal enforcement of court decisions and decisions of other bodies. As a result of the research, concrete and effective proposals were developed regarding theoretical structures and recommendations for the practical application of the legislation on executive proceedings and the implementation of state policy in this area. The exceptional importance of administrative and legal norms in the formation and implementation of the state policy of enforcement of court decisions and decisions of other bodies is emphasized, which consists in: 1) defining and legislating the strategic priorities for the formation of such a policy, outlining the hierarchical system of strategic planning documents; 2) coverage of the range of subjects of administrative and legal support for the implementation of state policy in the field of enforcement of court decisions and decisions of other bodies and their administrative and legal status; 3) normative definition of the instruments of administrative and legal support for the implementation of state policy in the field of enforcement of court decisions and decisions of other bodies, which act as an outwardly expressed activity of public administration, which is expressed in its application of various means, techniques and methods of administrative and legal direction; 4) consolidation of the system of guarantees by the state regarding the execution of court decisions and enforcement documents defined by the Law of Ukraine "On Enforcement Proceedings"; 5) clarification of the forms and methods of interaction and coordination of actions between all links of the system of public authorities on issues of both the formation and implementation of such policies; 6) regulation of the procedures for monitoring the activities of employees of state executive service bodies and private executors; 7) determination of the mechanism of bringing to administrative compliance for non-fulfillment of legal requirements of the state or private executor. State policy in the field of enforcement of court decisions and decisions of other bodies is defined as an integral component of intra-organizational national policy, a specific, priority activity of the state and its institutions, which includes a system of goals, priorities, tasks, principles, directions, mechanisms of its formation and implementation with with the aim of reducing the number of unexecuted court decisions, reducing the number of appeals to the European Court of Human Rights in connection with non-execution or long-term execution of national court decisions, and finally increasing the level of public trust in state institutions.
