The thesis is devoted to providing a theoretical generalization and a new solution to the scientific task, which consists in determining the essence and revealing the features of the administrative and legal provision of local state administrations of territorial defense in Ukraine, developing proposals and recommendations for improving the norms of administrative legislation in the relevant field based on the analysis of scientific literature, and leading samples of foreign experience.
It has been established that territorial defense should be understood as the sphere of activity of the state, local self-government bodies and the public, their interaction and coordination, which includes a system of activities carried out in peacetime and in a special period with the aim of forming a local culture of resistance at the level of established traditions, values, beliefs, ideological and cultural heritage of the local population, as well as a holistic awareness of the need to participate in the protection of the territory of their residence, which is formed at the level of culture and sports, national-patriotic education and the culture of family relations of the local population in order to ensure the national security of the state during military threats of information, energy, humanitarian and other types of character, as well as in emergency situations.
Attention has been focused on the fact that the first and fundamental feature of ensuring territorial defense is the formation of a resistant identity among the population at the local level. Other features of the provision of territorial defense in Ukraine include the focus on preventing spontaneity of resistance at the level of individual citizens, their groups, and organizations on the ground, as well as the focus on ensuring patriotic consciousness and sustainable motivation of the local population in the course of national resistance in the event of a full-scale invasion of the Russian Federation into Ukraine.
It has been emphasized that the importance of providing territorial defense in Ukraine should be considered through the prism of the unity of the mission, vision, and values of providing territorial defense. It was determined that the tasks of ensuring territorial defense should include: ensuring effective strategic communications at the local level; protection of critical infrastructure; ensuring cyber security; construction of security infrastructure; prevention and counteraction, along with military threats, to any other emergency situations related to natural disasters, radiation threats, the danger of the spread of epidemics and epizootics.
The principles that appear in the light of the reconstruction of security realities in Ukrainian society in the conditions of martial law have been singled out: the principle of constant readiness of the population for an attack, shelling or cyber-attack; the principle of stability of critical infrastructure; the principle of a close relationship with the global security of humanity in the course of ensuring territorial defense; the principle of active resistance and conscious denial by the population of Ukraine of any forms of cooperation with the enemy; the principle of taking into account current migration flows during the provision of territorial defense; the principle of preventing unjustified violation of human rights in the course of ensuring territorial defense.
It has been proven that under the conditions of martial law in Ukraine, the Verkhovna Rada of Ukraine and the President of Ukraine are the central subjects of ensuring territorial defense in Ukraine. National Security and Defense Council of Ukraine; Cabinet of Ministers of Ukraine; Ministry of Defense of Ukraine; Ministry of Education and Science of Ukraine; other central bodies of executive power; regional and district councils; village, settlement, and city councils; mayor; general staff of the Armed Forces of Ukraine; head of the regional military administration; police; public.
It has been emphasized that local state administrations in the system of territorial defense entities in Ukraine act as a connecting link, forming complex platforms for interaction with other entities.
