Karabin Y. Criminal and legal policy in the field of ensuring the protection of the activities of criminal justice bodies

The object of the study is social relations regarding the functioning of criminal-legal policy in the sphere of ensuring protection of the activities of criminal justice bodies. The purpose of the dissertation involves the study of issues related to the functioning of criminal-legal policy in the sphere of ensuring protection of the activities of criminal justice bodies. The theoretical and methodological foundations of the dissertation work are determined by the use of the principles of scientific knowledge, both general scientific and special: historical- legal, comparative-legal, hermeneutic, methods of analysis, synthesis, deduction, induction. The scientific novelty of the dissertation lies in the fact that the dissertation is the first in Ukraine study on the problems of functioning of criminal-legal policy in the sphere of ensuring protection of the activities of criminal justice bodies. In particular, the dissertation for the first time: - criminal justice is defined simultaneously as 1) one of the types of judicial activity aimed at implementing the law enforcement function of the state and 2) a unifying feature that serves as the basis for distinguishing a separate sphere of criminal law policy; based on the division of the spheres of criminal law policy into general and special, criteria for attributing criminal law policy in the sphere of ensuring the protection of the activities of criminal justice bodies to special spheres have been established; It has been proven that advisory bodies are participants in criminal law policy in the field of ensuring the protection of the activities of criminal justice bodies. The results of the study can be used in the development of generalizations and proposals for improving the formation and implementation of criminal law policy in the field of ensuring the protection of the activities of criminal justice bodies; to ensure the effective functioning of criminal justice bodies; for further research into special areas of criminal law policy in general and in ensuring the protection of the activities of criminal justice bodies, in particular; in teaching the academic disciplines "Criminal Law" (Special Part), "Criminal Law Policy", in the preparation of scientific and educational and methodological literature.
