Savchuk V. Criminal law policy in the field of liability for unfinished criminal activity

The object of the study is social relations regarding the formation and implementation of criminal law policy in the field of responsibility for unfinished criminal activity. The purpose of the dissertation involves the study of issues related to the allocation, formation and implementation of criminal law policy in the field of responsibility for unfinished criminal activity. The theoretical and methodological foundations of the dissertation work are determined by the use of the principles of scientific knowledge, both general and special: historical and legal, comparative legal, hermeneutic, methods of analysis, synthesis, deduction, induction. The scientific novelty of the dissertation lies in the fact that the dissertation is the first study in Ukraine devoted to the issues of criminal law policy in the field of responsibility for unfinished criminal activity. In particular, taking into account the division of the spheres of criminal law policy into general and special, the criteria for such a division have been developed and the classification of criminal law policy in the field of responsibility for unfinished criminal activity to general spheres has been established; Based on the approaches existing in science to understanding and systematizing the sources of criminal law policy, the need to divide them into normative and non-normative sources has been substantiated; the basic requirements of the modern stage of criminal law policy in the field of liability for unfinished criminal activity have been identified. The results of the study can be used in the preparation of proposals for improving the legislative provisions of criminal law policy in the field of liability for unfinished criminal activity; to ensure the unity of judicial practice in the implementation of criminal law policy in the field of liability for unfinished criminal activity; for further research into general and special areas of criminal law policy; in teaching the academic discipline "Criminal Law" (General Part), in the preparation of educational, scientific and methodological literature.
