Romanyuk B. Modern theoretical and legal problems of using of special knowledge in pre-trial investigation

Об'єкт дослідження - special knowledge, which are using in pre-trial investigation, their essence, significance, forms of realization, problems of procedural regulation their application. Мета дослідження - а) further development of the institute of special knowledge' theory within the framework of the modern methodological approaches on the basis of the native and foreign concepts of its development, investigatory and judicial practice, and also own empirical researches of the defined object and experience of their using at investigation of crimes; b) development of the theoretical and practical recommendations, legal and organizational questions of general using special knowledge in pre-trial investigation; c) justification of propositions in addition to improvement of legal regulation of using special knowledge in pre-trial investigation. Методи дослідження та апаратура - а) a dialectic method of knowledge of the social-legal phenomena; b) a logical-semantic method for study and deepening of the conceptual apparatus "special knowledge", "specialist"; c) the historical-legal method is applied by consideration of evolution of the institute of special knowledge and normative-legal base of their using in pre-trial investigation; d) a comparative-legal method for definition of a development' level of the criminal-procedural legislation, which regulates the relations in sphere of using special knowledge and outlining the means of its improvement; e) system, statistical and other methods. Теоретичні результати і новизна - the dissertation is a complex monographic research of modern theoretical and legal aspects of using special knowledge in pre-trial investigation. Практичні результати і новизна - the presented material, the formulated conclusions, provisions and propositions can be using in legal activity at preparation new and improvement of active criminal-procedural and other legislation of Ukraine; further scientific development of aspects of using special knowledge in pre-trial investigation; the educational process - at preparation of appropriate programs, lectures and other educational-methodical materials for the students of legal educational institutions and officials of the investigatory apparatus; methodical ensuring of practical activity of the inspectors and procurators. Предмет і ступень впровадження - by the results of the research are prepared and sent to the Committee on legislative ensuring of law-enforcement activity of the Verkhovna Rada of Ukraine the propositions in addition to improvement of legal regulation of application of special knowledge in pre-trial investigatory. Ефективність впровадження - the propositions and the recommendations received a positive estimation. Сфера використання - legal activity, practical activity, educational process, and scientific activity.
