Essay

The dissertation is devoted to the research on international and legal commitments of Ukraine under the European Convention on human rights and provisions of its interpretation by the European Court of human rights. Having analyzed the legal character of a decision of the European Court of Human Rights the author underlines the necessity of application of Court decisions by the Ukrainian courts, particularly by the Constitutional Court of Ukraine. The status of the European Convention on Human Rights within national legislation was analyzed and this research proved the existence of collisions between conventional norms and provisions of Ukrainian legislation. The research proved that the more effective fulfillment of the international and legal commitments of Ukraine under European Convention is a stipulation for deeper integration to Europe, first of all, to the European Union.
