Essay

The dissertation researches the role of international economic organizations in a law-making process. This work it elucidates a law-making activity of international economic organizations. The thesis deals with concept of international economic organizations and its special features, international legal status of international economic organizations and basic elements of the status, a law-making process within the framework of the international economic organizations and nature of legal acts of international economic organizations. The basic vector in the activity of international economic organizations is a law-making process, which enhances the establishment of international standards, legal norms and promotes the development of states and relations among them. While drafting any legal acts, international economic organizations operate in conformity with their competence and within the framework of those powers which are granted to them international law. Law-making of international economic organizations is manifested in adoption of legal acts, in signing international agreements with states and international organizations, in creating legal norms. Legal acts, approved within the framework international economic organizations, influence international law-making and, as a rule, have a mandatory or recommendatory character. International economic organizations adopt different kinds of legal acts: resolutions, instructions, decisions, directive, conclusions and recommendations. Acts, regulating questions of internal law of international economic organizations, have a binding character. Decisions, referring to external law of international economic organizations, are both mandatory or recommendatory by character. Some international economic organizations produce mandatory decisions for their members-states, physical and legal persons. On the other hand, recommendations of international economic organizations, having a recommendatory character, may influence the activity of international economic organizations. The current process of economic integration and prospects of legal cooperation of Ukraine with international economic organizations are also analyzed in the dissertation. At the present stage of development international economic organizations actively cooperate with many states in the field of economy, trade, transport, industry, communication, etc. Since the time of gaining its independence, Ukraine has been facing an objective necessity to establish and develop relations with many influential economic organizations, such as the WTO, the EU, the EAFT. The basic means for the establishment of relations with international economic organizations is conclusion of international economic treaties on cooperation and harmonization of legislation of Ukraine in compliance with international and European standards.
