Essay

The dissertation is devoted to the research of arrest as a born of criminal punishment, the peculiarities of its standard regulation, prescription, execution and serving. The analysis of the other countries’ legislation in legal regulation of arrest as a form of criminal punishment is carried out. General and specific signs of arrest as a form of punishment are examined. For the first time in the native criminal-law doctrine the specific signs of arrest are determined and the conception of arrest in the wide and narrow meaning is formulated in the present work. It’s argued by the author that arrest is an independent form of criminal punishment.
