Koval'chuk S. The implementation of defence in criminal cases on principles of competitiveness and dispositiveness.

The research contains a series of theoretical and practical issues relevant to implementation of the defence in criminal cases on the basis of competitiveness and dispositiveness. The mechanism of realization of the principles of competitiveness and dispositiveness in activity of defence during investigation, preliminary hearings of the case and first instance hearings of the case are determined on the basis of the analysis of norms of criminal-procedure legislation, theoretical materials, investigatory and judicial practice. Scientifically grounded proposals on improvement of norms of criminal-procedure legislation, which regulate the order of implementation of the rights of subjects of the defence to plead not guilty and directed at the ruling out or mitigation of criminal punishment of the suspect, the accused and the defendant. The thesis results enrich theoretical bases of criminal procedure; they can be applied for improving the current legislation and for improving activity of defence."
