Essay

European Community competition law is one of the areas of authority of the UE.Competition law,or antitrust as it is known in the United States,regulates the exercise of market power by large companies,governments or other economic entities.The complex of legal norms which regulate the relations of competition at the common market of theEUis analysed in thesis.On the basis of the conducted analysis the features of creation and development of competition law of theEU,the degree of influencing of antitrust law of the USA is found out on forming of competition law of the states-members of theEUand actually competition law of theEU.On the basis of analysis of approaches of doctrines obtained subsequent development of determination of concept "competition".Except for it in thesis differences were explored in adjusting of relations of competition at the internal markets of the states-members of theEU.In thesis was also explored organizational and legal mechanism of providing of competition at the common market of theEU.The reform of competition law of theEUof 2003 has influencing on the mechanism of application of norms of competition by the states-members of theEU,by national competition and judicial bodies;fourthly,the decisions of the Commission of theEUand the case law of theEUropean Court of Justice plays a determining role in the interpretation and application of norms of competition law of theEU.In thesis the comparative analysis of antitrust legislation of Ukr.was also conducted in the spectrum of its harmonization with a competition law of theEU.The analysis of this question witnessed that Ukr.antimonopoly legislation needs perfection in the field of procedural law,in particular creating and adopting the procedural antimonopoly code.
