Essay

The range of requirements set by the public opinion and by the positive law to the personality of the trustee has been defined. The author also considers the reasons for conflicts arising between the guardians and the wards, and the most typical ways of overcoming such conflicts. The dissertation also includes analysis of the effectiveness of state and public interference in the relations "guardian - ward" and of real possibilities of applying the historical experience of functioning of the institute of guardianship and protection of orphans in traditional Ukrainian society of Galicia to current social and juvenile policy of independent Ukraine.
