Kovbasa Y. Legal characteristic of procedural criminal institution of exclusion of conversion to worse

The research is devoted to investigating theoretical and practical issues of realization procedural criminal institution of exclusion of conversion to worse on different stages of criminal justice. The nature of given institution as an important guarantee from groundless charges that takes prominent place in the mechanism of the defense of rights and legal interests of the defendant, the accused, the convict has been investigated; the issues of amendment of accusation on prejudicial stages of criminal justice and in court of first instance have been researched; the peculiarities of promotion the convict’s and the acquitter’s right on defense in appellate court and appeal instance court as well as during reconsideration of legal decisions in process of exceptional proceedings have been researched. The correlation of the charge and the institution of exclusion of conversion to worse has been covered; the legal nature and the contents of this institution in the criminal procedure have been ascertained. The peculiarities of amendment of accusation by the investigator during the prejudicial inquiry and by the public prosecutor during the confirmation of the indictment have been researched. The offers as for the improvement of current procedural criminal legislation of Ukraine in the sphere of legal reglamentation of the institute of exclusion of conversion to worse have been given.
