Malanchuk P. The Function of Defence in Criminal Procedure of Ukraine

The dissertation deals with the comprehensive studies of the distinctive features of the realization of the defence function in the criminal procedure of Ukraine. The thesis is devoted to the problems of legal regulation of the defence function in the criminal procedure. As the result of the conducted study, the knowledge of the concept, content and essence of this function, the pre-trial and trial conditions of its realization was extended. It was grounded the necessity of the strengthening of the defender's status, the extension of the system of the procedural guarantees of his activity with the object of full realization of defendant's rights and liberties. In accordance with the conducted analysis of the international legal acts, the legislation of the other countries and Ukrainian legislation in force, the subsequent development line of the defence function in the criminal procedure of Ukraine was defined; the ways of improvement of the defence function in the criminal procedure of Ukraine were suggested.
