Essay

Dissertation is related to the study of international legal regulation of nuclear materials' physical protection. The work clarifies current trends of development of the international regulatory documents' requirements in the sphere of nuclear materials' physical protection. On the base of analysis of the norms of international legal acts, the rule-making dynamics in the sphere of international legal regulation of nuclear materials' physical protection, and interrelation of the norms of physical protection with the IAEA safeguards system and nuclear materials' export control, normative legal meaning of international legal regulation of nuclear materials' physical protection is determined. It was performed analysis of the international acts requirements related to creation of the system of nuclear materials' physical protection. Studied are international legal aspects of criminal responsibility for crimes directed to unauthorized taking and using nuclear materials and nuclear plants, and determined thelevel of conformity of the criminal law norms of the states members to provisions of Convention on the Physical Protection of Nuclear Material 1979 to the approved in 2005 Amendment to it. Specific proposals and recommendations for improvement of the norms of legislation of Ukraine in the sphere of provision of nuclear materials' physical protection have been developed.
