The dissertation is dedicated to the complex analysis of court activity in the pre-trial proceeding, detection of the possible ways of improvement of the mechanism of realization of court activity in the pre-trial proceeding. The legal basis of the court activity in the pre-trial proceeding have been researched; eliminated court's functions in the pre-trial proceeding; defined the aim, object, subject and the limits of the court activity in the pre-trial proceeding, opened legal and organizatorial tools of the court activity during the application of procedural coercion, discovered legal and organizatorial tools of court activity during the grant of permission for the procedural and investigation and search operations, disclosed legal and organizatorial tools of court activity concerning the consideration of complaints on actions and decisions of authoritative subjects of criminal process. Examined problems of normative regulation and realization of court's enabling function in the pre-trial proceeding, judicial review in the pre-trial proceeding, functions of the application of the procedural coercion in the pre-trial proceedings."
