The Dissertation is dedicated to consideration of theoretical and practical foundations of the problem of misuse in the area of criminal process of Ukraine. Development of the problem of misuse of criminal and procedural rights and powers on the basis of analysis of historical and theoretical sources is highlighted, the basic features of misuse in the area of criminal process are characterized and the definition of it is proposed. Opinions regarding legal nature of misuse of law in the area of criminal and procedural relationship, its correlation with criminal and procedural delinquency and mistake are summarized, classification of misuse of criminal and procedural rights and powers is developed. Systematization of consequences of misuse of criminal and procedural rights and powers on the basis of analysis of the criminal and procedural legislation is proposed. Separate forms of misuse are detailed, proposals on improvement of the criminal and procedural legislation of Ukraine and practice of application of it are developed.
