Essay

The dissertation is dedicated to researching the international legal regulation of nuclear material transfers, the principal theoretical and practical aspects of the issue being analysed. The author adduces rules from various international legal sources systematizing them, such rules concerning the only question of the overall admissibility of nuclear material transfers. That means that they determine whether a particular transfer is to be allowed or denied. Such an approach predetermines the large number of sources analysed, including the IAEA Statute, the Non-Proliferation Treaty, the Convention on the Physical Protection of Nuclear Material and Nuclear Facilities, the International Convention for the Suppression of Acts of Nuclear Terrorism, the Joint Convention on the Safety of Spent Fuel Management and on the Safety of Radioactive Waste Management, and, on the other hand, the Treaty Establishing Euratom, GATT-1994, the Energy Charter Treaty, etc, in particular a large number of bilateral treaties.
