Kulakova E. Economic jurisdiction of regional councils and regional state administrations

Research object: public relations which arise up in connection with forming and realization of economic jurisdiction of regional soviets and regional state administrations. Research purpose: development of new theoretical positions of concept and maintenance of economic jurisdiction of regional soviets and regional state administrations and preparation of suggestions on the improvement of legislation of Ukraine, which determines such jurisdiction, practices of his application. Research methods: historical, comparative, legalistically-logical, system-structural, logiko-legal. Theoretical and practical value: the row of concrete suggestions is formulated on the improvement of national legislation, which can be utilized in a zakonotvorcheskom process. Separate suggestions are developed on making alteration in the Economic code of Ukraine, Laws of Ukraine "On local self-government in Ukraine", "About local state administrations" which were approved and borne for consideration in Verkhovna Rada of Ukraine. Separate positions are utillized the specialists of legal department and management of common property of territorial societies sat down, settlements, cities of the Zaporozhia area of the Zaporozhia regional soviet; By Zaporozhia regional state administration at development of project of strategy of economic development of the Zaporozhia area to 2015 year, and also in an educational process at teaching of educational disciplines the "Economic right", "Communal right". The given paper analyzes general ways of concept's classification and competence elements, existing in the law science. It provides the definition of concept of economic jurisdiction of regional councils, economic jurisdiction of regional state administrations, reveals the components of economic jurisdiction of regional councils and regional state administrations, namely competence and subjects under jurisdiction. It provides the formulation of general principles of regional councils' jurisdiction's designation in the economic activity sphere. It analyzes the jurisdiction of regional councils and regional state administrations with them being considered the participants of relations in economic activity sphere. It specifies the legal basis of realization of economic jurisdiction of regional councils with them being considered local government bodies and legal principles of activity of local state administrations. In the frameworks of the paper were investigated the peculiarities of economic jurisdiction realization by regional councils and regional state administrations. The paper analyzes the foreign experience of legal ensuring and realization of jurisdiction of local government bodies and of executive state authorities of corresponding level in economic activity sphere. There were prepared the proposals concerning the improvement of economic jurisdiction of regional councils and regional state administration and sequence of their realization on the basis of the research carried out through the dissertation.
