The Thesis is devoted to theoretical generalization and new resolving of scientific task of developing theoretical bases of institution of marine practice in the process of forming modern international marine law.Also in Thesis is offered the scientific position about existence of uniform process of the modern international marine lawmaking, which includes consecutive change of processes of custom and contractual norms making and the model of process of the modern international marine law that can be called the three-phases.
