Zubko G. Marginal behavior as type of legitimate behavior of a person.

Analyzing the points of view of scientists, the author marks that, especially in the context of description of category «marginal behavior of a person», they are similar. However, the description of this type of legitimate behavior is completed at the terminological level. That is description of signs, composition, kinds, reasons and consequences of marginal behavior as the legitimate behavior of a person are absent in scientific literature. Under marginal behavior of a person one should understand such variety of legitimate behavior, that occurs in a form of inner personality conflict, expressed in ignoring legal permissions, takes into account own ambitions and interests only, accompanied by the observance of legal prohibitions and predefined by objective reality and low level of legal culture and legal consciousness of a person. Marginal behavior of a person can be classified according to many signs and criteria: 1) according to the sphere of public relations: social; economic; political; psychological, etc.; 2) depending on a subject: marginal behavior of a person; marginal behavior of a group; 3) from the point of view of analysis of psychical factors : asocial; amoral; 4) relative to back reaction to the action of mechanism of the legal regulation : voluntary; forced; 5) according to a form of demonstration: active, ordinary and passive; 6) according to the criterion of its stability : permanent; situational; 7) depending on requirements that are covered : social-oriented, personality-oriented, ego-oriented. The component elements of marginal behavior of a person have been described; its reasons and consequences have been analyzed in the dissertation. Directions of preventive measures of marginal behavior of the population of Ukraine and the police in Ukraine have been exposed. The long list of the used marginal behavior research methods allowed avoiding one-sidedness and undesirable elements of subjectivism that testifies to the complex character of dissertation research.
