Ptukha S. Legal aspects of Council of Europe's activity in the sphere of protection and usage of cultural heritage

The thesis deals with the analysis of the legal bases of the activities of the Council of Europe in the protection and use of cultural heritage, as well as determining effective instruments to implement the relevant international legal norms into domestic law of Ukraine. The dissertation investigates the formation and development of the European heritage law, peculiarities of its conceptual and terminological apparatus, highlights the features of the regional policy in the protection and use of cultural heritage, reveals the legal and organizational problems in this area. The thesis analyzes theoretical and practical implementation of the concepts of cultural heritage and common heritage of mankind in modern international law. The author pays particular attention to characteristics of the content of the practical aspects of the Council of Europe activity through the institutional framework of international legal protection and use of cultural heritage, generated within it. The thesis reveals legal basis of cooperation of Ukraine with the Council of Europe in the field of cultural heritage and presents recommendations for improving national legislation in this area.
