Essay

The thesis is devoted to the сomprehensive study of history of the formation of modern international legal status and regime of the Black Sea straits. It examines the legal problems of the use and regulation of maritime spaces of Black Sea-Azov basin which currently have a high degree of relevance. Recent changes in the legal regime of the Black and Azov seas are caused by geopolitical, economic and ecological processes in the region. The adoption of the new Black Sea States national acts for regulation of the exercise of sovereignty and jurisdiction over the sea, the transformation mode of the regime of the Straits, contractual status process and the mode of the Azov Sea and the Kerch Strait demonstrate the dynamics of the legal regime of the sea areas the Black Sea-Azov basin. The work focuses on the study of the law of coastal States for compliance with the provisions of general international and maritime law, especially the Convention on the Black Sea Straits 1936 and the UN Convention on the Law of the Sea 1982, the identification of inconsistencies and gaps in national legal systems. The thesis substantiates the position of securing the legal status of the Sea of Azov as internal waters of Ukraine and Russia, and demarcation of the state border, which is the most appropriate solution to this problem and to further the effective use of maritime space.
