Essay

Theoretical and practical issues of international legal regulation of private military and security companies’ activity are studied. The thesis analyses international rule-making initiatives on the regulation of private military and security companies’ activity and perspectives of international legal codification of their activity. The nature and peculiarities of the Montreux Document is characterized. The thesis conducts a formal legal analysis on provisions of the Draft International Convention on Regulation, Oversight and Monitoring of Private Military and Security Companies, perspectives of its adoption and its subject scope. Conceptual approaches to the international legal regulation of private military and security companies’ activity are determined. Inquires into the genesis of international legal regulation of mercenaries’ activity and prototypes of private military and security companies in historical retrospective. Defines the notion of “private military and security company” in the doctrine and practice of international law and the classification of their functions. The thesis characterizes international legal aspects of military and security activity of private military and security companies, which is not related to armed conflicts, and the issue of human rights observance. Determines problems of the international legal regulation of private military and security companies’ activity in times of armed conflicts and discovers the legal status of private military and security companies’ personnel in times of armed conflicts. The thesis develops scientifically grounded propositions on the participation of Ukraine in international legal cooperation on the regulation of private military and security companies’ activity.
