The thesis provides the complex research of the international cooperation in the penal sphere. In order to understand the nature of the emergence of international cooperation in the penal sphere, the stages of development of such cooperation are examined in thesis. Regional and universal international documents which regulate penal problems are researched in the thesis. Examined the activities of such defense mechanisms of the convicts? rights as UN Committee against Torture, UN Sub-Committee against Torture, National Preventive Mechanisms, The European Committee for the Prevention of Torture, European Court of Human Rights. Fundamental rules and principles for the treatment of prisoners incarcerated by the International Criminal Court decision are researched. Formulated the directions of the reformation Ukrainian penal system.
