For the first time in national legal literature, a complete holistic scientific research of hypothec of facilities under construction in progress is conducted. Preconditions and laws establishing and developing the institution of hypothec are identified. Content, general and special principles of hypothec are main focus of research. The notion as well as legal characteristics of facilities under construction in progress are provided. Main legislative approaches to regulation of hypothec of facilities under construction in progress abroad are developed. Peculiarities of legal regulation of hypothec of facilities under construction in progress in Ukraine are identified. Civil contract is characterized as a precondition to arising, alternating and discontinuing legal relations of hypothec of facilities under construction in progress. The value of notarization and state registration for legal relations of hypothec of facilities under construction in progress is unfolded. Peculiarities of judicial and notarial protection of rights of entities in hypothec of facilities under construction in progress are defined. Scientifically grounded propositions about making amendments to the current legislation of Ukraine in regulation of hypothec of facilities under construction in progress are expressed.
