Harkusha Y. Economic and legal framework for production and trade of medical devices and medical equipment

Research object: is social relations that arise in the process of organization and implementation in Ukraine of the production and trade of medical products and medical equipment. Research purpose: development of theoretical provisions and practical recommendations on improvement of legal support of the production and trade of medical products and medical equipment. Research methods: dialectical, formal logical, historical, comparative legal, analytic-synthetic, systemic-structural, logical-legal. The theoretical and practical value: deepened and perfected in the science of economic law theoretical development of economic-legal support of relations in the sphere of production and trade of medical products and medical equipment, developed scientific principles and proposals to improving legislation in this sphere. The proposals made in the thesis, used in the practice of pharmacy, LLC "Falbi-Poltava" and industrial-commercial enterprises, LLC "NOZZLES", LLC "ZIO", LLC "Circle Global", Kromtech Alliance Corp. Scientific novelty: it is argued that it is expedient in the legislation of Ukraine to use for marking medical devices and medical equipment generic term "medical device". Selected characteristics of business entities that carry out production and trade of medical devices and their classification is given. Considered economic and legal means of organizing production and trade of medical products and medical equipment, proposals on improvement of the legislation providing for the procedure and the conditions for their application. Analyzed the content of commercial contracts in the study area with the development of proposals for regulatory consolidation additional list of essential terms of contracts for their implementation. Advantages and disadvantages of separate economic and legal means of state incentives in this area and developed proposals to clarify the provisions of the relevant acts of legislation of Ukraine. It identifies directions of perfection of legal regulation of production and trade of medical products and medical equipment at the harmonization of Ukrainian legislation with the similar legislation of the EU. Scope of use: the subjects of legislative initiative, the constituent entities of law enforcement, business entities; institutions of higher education.
