Essay

The paper reveal theoretical and practical aspects of the functioning of the Council of Europe Commissioner for Human Rights. Special features of the Council of Europe institutional system development and its impact on the activities of the Commissioner are considered. Also considered the evolution of powers of the Commissioner for Human Rights, his informational and educational activities and his role as a third party in the proceedings before the European Court of Human Rights from its creation to the present time. Considered informational and educational role which is inherent for the Commissioner. Analysis of the institution concluded that its periodic monitoring tend to become permanent. Thesis reveal the peculiarities of powers of the Commissioner as an organ that created by the organization to achieve its statutory purposes, but also as the authority which partially has the conventional competention, with his power to take part as a third party in the proceedings before the European Court of Human Rights. The prognosis given for the adoption of the act, which with the provisions concerning the authority of the office of the Commissioner and his representatives in Council of Europe member states would be legislated.
