Essay

The thesis is devoted to complex research of international treaties of Ukraine on legal assistance in civil cases as the acts of international law, including the characteristics of their detention, execution and termination. Also studied the succession of Ukraine concerning the characteristics of this group of contracts to meet the requirements of Article 7 of the Law of Ukraine "On Succession of Ukraine". The modern global trends contractual and legal regulation of international legal assistance in civil matters, including, drawn attention to such innovations as the creation of international bodies monitoring the observance of the norms examined multilateral treaties. The paper drew attention to the characteristics of bilateral, regional and general agreements on legal assistance in civil matters, concluded with the participation of Ukraine, in particular, that they all have common features, ensuring the formation of a unified international legal spaces of legal assistance in various areas of its provision. The thesis deals with questions of implementation in Ukraine of international treaties on legal assistance in civil matters, in particular taking into account that giving consent to their binding is not always going through the ratification as well as taking into account the adoption of the Ukrainian legislation and the judicial practice of the concept of self-fulfilling international legal norms . Whereas Article 27 of the Convention on the Law of Treaties of 1969, given the international legal assessment of the clauses "public order", "national security", "sovereignty" and "national legislation" in the treaties on legal assistance in civil cases.
