Essay

The object of research is the social relations that arise in the process of trade union activity as an institution of civil society and the factor of the formation of a social and legal state. The subject of the study is the general theoretical principles of the participation of trade unions in the development of a social and legal state. The scientific novelty of the research is that: for the first time: - the conclusion is based on the special role of trade unions in the process of developing a socio-legal state, which consists in establishing a connection between society and the state, in particular, through the participation of trade unions in the process of developing and adopting normative and legal acts of public control over the activities of subjects of power, providing legal assistance, representing the interests of citizens, law-education work, performing the role of the regulator of social conflicts; Improved: - understanding of the main features of trade unions, which determine their special place in the process of interaction between the state and civil society, in particular such as: the number, polyfunctionality, multi-sectoral, participation in the mechanism of ensuring human rights and citizen, focusing on meeting public interests, promoting implementation right to strike, participation in social dialogue; received further development: - the provision on the definition of the object of trade union protection not only labor, socio-economic rights, but also other types of rights, in connection with which the proposal to lay down Part 1 of Art. 2 of the Law "On Trade Unions, Their Rights and Guarantees of Activity" as follows: "Trade unions are established for the purpose of representing and protecting labor, social, economic, environmental, cultural and other rights and interests of trade union members"; - the division of the forms of trade union activities in the field of ensuring human rights in jurisdictions (representing the interests of citizens in commissions of labor disputes, commissions on social insurance, housing issues, state bodies, local self-government bodies, courts, etc.) and non-jurisdiction (collective forms of protest , participation in social dialogue, implementation of legal education, participation in law-making process, etc.).
