Sichko V. Applying, vacating and change of a measure of restraint in court proceedings.

Theoretical and practical aspects of normative regulation of the procedural order for the applying, prolongation, vacating or change of a measure of restraint in court proceedings have been comprehensively studied. The development and current state of scientific knowledge about the institute of measures of restraint in criminal proceedings have been characterized. Peculiarities of a procedural mechanism of measures of restraint application in court proceedings have been revealed. Directions of possible improvement of normative regulation of application of a measures of restraint in court proceedings have been analyzed, taking into account international standards, foreign experience, and legislative tendencies in Ukraine. On the basis of the conducted research and generalization of the law enforcement practice, shortcomings of the legal regulation of the procedural order for the application of measures of restraint in court proceedings have been identified, and scientifically substantiated proposals aimed at improving the existing criminal procedural legislation have been formulated.
