Honcharova O. Theory and Practice of Refusing to Support the Public Prosecution

In the dissertation on the basis of the current legislation, a comprehensive study of the concept and essence of the state prosecution, the institution of the full and partial refusal of the prosecutor from the state prosecution has been carried out. In particular, the grounds, the procedural order and the legal consequences of the refusal of the state prosecutor to be prosecuted systematically are considered. In work, taking into account the positions of other authors, not only the essence of the functions of maintaining the prosecution in court, but also the problems of ensuring the rights and interests of participants in criminal proceedings arising as a result of the refusal of the prosecutor from an indictment in court, which remain unsolved under the current Criminal Procedure Code of Ukraine.
