Essay

The dissertation is one of the first in the national theoretical and legal science complex researchs in which the general theoretical principles of legal paradigms are considered through the prism of its theoretical and methodological principles. The specificity, structure, and forms of expression of legal paradigms in practical and scientific-theoretical activity are analyzed. The importance of general theoretical foundations of legal paradigms for legal science and legal practice is proved, the level of influence of legal paradigms on the mechanism of legal regulation is determined. The definition of general theoretical foundations of legal paradigms has been deepened. The definition of the concept of "legal paradigms" is substantiated, their classification is made. The reasons for the change of legal paradigms, their general theoretical foundations in the concept of "spirit of time" are revealed. The functions of legal paradigms from their general theoretical principles and in practical importance for legal activity are defined and substantiated. It is proved that legal paradigms effectively influence on the legal system through its philosophical and legal components of the theory of state and law. It is proved that the general theoretical foundations of legal paradigms are formed in the environment of legal scientific communities, based on real conceptual legal phenomena perceived by the subjects of law enforcement. The main purpose of legal paradigms has been established.
