Vlasiuk V. Legal insurance for the protection of the activities of a lawyer or a representative of a person, during providing legal assistance

In the thesis, it was proposed to unify the signs of responsibility for crimes against persons who protect or represent the person, giving it legal aid, and to predict it in Articles 343–348 of the Criminal Code of Ukraine (Articles 397–400 are proposed to be excluded from content of the Criminal Code of Ukraine), as well as change the name of section XV of the Special Part of the Criminal Code of Ukraine, defining it as follows: «Crimes against the authority of state authorities, local governments, associations of citizens and certain types of professional activity». It is proposed to take into account that criminal law norms providing for responsibility for crimes against a certain type of professional activity are not placed in the section of the Special Part of the Criminal Code of Ukraine dealing with crimes specifically against certain types of professional activity, but in a section that, at least based on the name, contains the rules by which measures of criminal law response are provided for encroachment on a completely different group of social values – in the framework of which effectiveness to the realization of justice.
