Balatska O. Proof of fraud at railway transport facilities during the pre-trial investigation

In the dissertation, the research of the process of proving at the pre-trial investigation of the facts of fraud at the objects of railway transport is carried out. Attention is focused on the importance of establishing the event of a criminal offence and its components – time, place, method and other circumstances of the analyzed criminal offence. Other elements of the subject of proof, defined in part 1 of Article 91 of the CPC of Ukraine, which are subject to proof in criminal proceedings, are considered. The content of some investigative (search) actions aimed at proving fraud at railway transport facilities is analyzed. Recommendations for the organization and conduct during the investigation of these criminal offences of inspection, search, interrogation, presentation for identification, investigative experiment, appointment of examinations, the most common of which are dactyloscopy, tropological, handwriting, examination of materials, substances and products, commodity, technology-forensic examination of documents.
