Bozhyk V. Ensuring the rights of the individual during the pre-trial investigation of criminal offenses

The dissertation is one of the first comprehensive monographic studies in Ukraine of theoretical and practical problems of ensuring the rights of the individual during the pre-trial investigation of criminal offenses, taking into account the current state of legislation and law enforcement. Based on the analysis of scientific sources, questionnaires of prosecutors and investigators, the study of judicial and investigative practice the paper substantiates a number of new conceptual provisions, conclusions and recommendations. The historical review of the state of ensuring the rights of individuals during the pre-trial investigation of criminal offences in the criminal process of Ukraine was conducted. The theoretical basis for ensuring the rights of the individual during the pre-trial investigation of criminal offences has been clarified. The standards of proof in proceedings on criminal offences are described. Specific features of ensuring the rights of the individual have been identified in the application of measures to ensure criminal proceedings and in the conduct of investigative (search) actions during the pre-trial investigation of criminal offences. The peculiarities of ensuring personal rights at the end of preliminary investigation of criminal offences are revealed. A review of the status of ensuring the rights of the individual during pre-trial investigations of criminal offences under foreign law has been carried out.
