Essay

The thesis is devoted to the analysis of legal regulation of financial and credit relations in public international law. In the framework of the research, for the first time, the necessity of the allocation of the institute of international financial and credit legal relations was substantiated and its place in the system of international law was determined. This institute can be defined as a set of legal norms regulating financial, economic, and monetary legal relations that arise between subjects of public international financial law, which are based on the public interest of the state regarding the effective internal functioning of the economy. The institute of international financial and credit relations is an independent institute of international financial law, which in turn is a sub-branch of international economic law in the structure of public international law. It was clarified that an international treaty today is an important and main source of modern financial and credit relations, and acts of international organizations serve as an auxiliary and clarifying source of international economic law, and their perfect combination can be considered as a feature of international financial and credit relations. The paper examines the influence and limits of the application of the general principles of law, the basic principles of international law and the branch principles of international economic law in international public financial and credit relations for the first time. It is established that the system of sources of international financial and credit relations is quite developed and well-established, which can testify above all to the development and formation of this institute of international financial law in particular and in general. It has been found that, unlike national legislation, there is no difference in the use of the terms «credit» and «loan» in international law.
