The dissertation provides a theoretical generalization and a new solution to the scientific task, which consists in clarifying the essence and peculiarities of the theoretical and legal foundations of the effectiveness of law enforcement acts, based on the analysis of the scientific views of scientists and the norms of current legislation, on the basis of which to develop a number of proposals and recommendations aimed at increasing the effectiveness of law enforcement acts.
A general theoretical description of the law-enforcement act is given as a creative, state-authority, formally fixed individual decision of an authorized subject, adopted in the prescribed manner on the basis of legal norms, aimed at resolving a specific situation. The theoretical and methodological approaches to the concept and methodology of determining the effectiveness of law enforcement acts are revealed. The concepts of «effectiveness of a law enforcement act» and «efficiency of a law enforcement act» are distinguished, which are interrelated, but have different accents and aspects in their content. The main requirements for the effectiveness of law enforcement acts are revealed. It is argued that in the context of the natural-law approach, such a requirement for the effectiveness of law-enforcement acts as justice, which must be perceived in a broad sense, takes on special importance - in relation to the entire process of establishing facts, their research, qualification and, ultimately, the law-enforcement act itself.
Factors affecting the effectiveness of law enforcement acts are revealed, in particular, legal means of ensuring the effectiveness of law enforcement acts, which represent a three-unit system consisting of means of standardizing, guaranteeing and ensuring the legal and technical perfection of law enforcement acts, as well as non-legal means of the effectiveness of law enforcement acts. The specifics of monitoring the effectiveness of law enforcement acts as a systematic activity of monitoring entities related to the accumulation and analysis of information about state authorities and local self-government bodies with the aim of identifying compliance with a certain standard of law enforcement acts issued by these bodies are determined. Directions for improving the effectiveness of law enforcement acts are being clarified.
Scientific conclusions have been formulated that will contribute to the expansion of the limits of scientific analysis of the effectiveness of law enforcement acts, the further development of the theory of the state and law, and the practical solution of some problems related to the improvement of the effectiveness of law enforcement acts.
