Investigation object - problems of criminal responsibility for border service violation. Investigation aim - to work out proposals and recommendations on the improvement of criminal law and practice of criminal-legal struggle with border service violation; to activate judicial-inquiry practice. Investigation methods and apparatus -systematik approach principle to wards investigation of social phenomena ; fanctional, historical and legal, logical, statistical methods; modeling; forecasting. Theoretical and practical results- social criminal stipulation of border service violation has been substantiated; social and legal criteria of proper criminal-legal prohibition establishment are determined; obligatory signs of that corpus delicti have been defined; direct object of border service violation is determined; formulating material construction of that corpus delicti as a law has been suggested; determinate necessity of criminal responsibility for border service violation caused serious consequences i s substantiated;establishing such a form of release from criminal punishment for military crimes as discharge with dispatch to the disciplinary unit; necessity of criminal-legal exposition which provides responsibility for border service violation in a new interpretation has been substantiated.Research results can be used in the process of work on the "Criminal Code of Ukraine " project , in teaching process when studying the course of "Particular Part of Criminal Law " and other special courses.
