Essay

The dissertation deals with State responsibility for violations of international human rights obligations. The research is based on such a methodological premise that when studying and solving practically issues of State responsibility in the field of human rights, one has to proceed not from the individual rights and freedoms, but corresponding international obligations. In the dissertation general theoretical and special scientific methods have been applied. The specific nature of international human rights obligations of States has been elaborated and their classification has been carried out. The elements of an internationally wrongful act have been analysed. The substantive and instrumental consequences of human rights violations, both within international conventions and general international law, have been characterised. The inadmissibility of a unilateral humanitarian intervention has been proved and the criteria of legality of armed enforcement actions applied by the UNO and regional organisat ions have been proposed. The results of the research might be used in the human rights theory and practice.
