Essay

Monograph is devoted to the analysis of the category "cause-effect relation" applied to the tasks, which are faced with the science - criminal law and the practice of criminal law application. Research is based on comparison of different philosophical and criminal law conceptions. There was an attempt to expose the most acceptable approaches to determine causal rela-tion as one of the characteristics of objective side of a crime from the point of view of logical mutual understanding and those which meet humanistic trend. Precondition of this fact is a precise direction that determinism and causality are categories, which are coinciding. Objective character of causal relation in the aspect of "goal causality" was specified. Linguistic data about the origin of category "cause" was analyzed and it was affirmed that category of causation arises from the essence of matter - its activity. Author believes that indications of causal relation should be placed in two levels - ontological and gnosiological. It has been shown that either chance or necessity can't be used for definition of causal relation as ontological category. It is stated that causal relation can't be statistical. Existence of certain statistical regularities doesn't prove the presence of causal relation under consideration of concrete pair of events. Additional arguments in fa-vor of causal relation's existence under specific circumstances on the vic-tim's territory are listed. Some data is adduced that ontological indication of causal relation - "result" can't be formalized. For "result" statement the method of linguistic intuition was proposed. The problems of "informative causation": information influence on person's behavior or his condition, were analyzed in the light of linguistic intuition method. Situations where informational signal is not a bearer of a cause but a stipulated factor were exposed. In the same way determining role of secondary accomplice in or-der to gain the result made by executor was analyzed. There were stated some arguments that omission to act can serve a bearer of cause only in in-formative aspect, but not always, only in that cases, when its influence is carried against owner's will. On the base of logical and philosophical analysis of combined twin categories "cause-effect" we can make a conclu-sion that causal relation doesn't have its own place in the system of objec-tive side of crime's indications, because under the term "effect" can be considered the event, which is in cause relation with an action. Many other issues, which can appear in judicial practice, are considered in this mono-graph.
