Essay

The work presents a theoretical research aimed to carry out the over-all analysis in the context of existing problems and conceptual ways of their solving through revealing the logic of modern international maritime law evolution as well as studying the structure forming practice and this system contents. The method of the system analysis on which the research is based has allowed to conclude that the World Ocean is not homogeneous in legal aspect. Its spaces consist of separate elements (categories of sea spaces) which legal regime is really regulated by huge amount of binding and non-binding instruments, and their adoption is in the competence of international organizations and their bodies in some cases and in other cases - in the competence of states, these are cases - their adoption is in competence of both above. Special attention has been paid to the Black sea - Azov sea region and the policy of Ukraine regarding the right to use sea.
