Essay

The dissertation aims at creating an integral international legal concept of international crimes within the framework of international fight against crime. The present paper focuses on studying the genesis and legal character of international crime; analyzing and generalizing the main doctrinal approaches previously used in examining this phenomenon; developing its international legal definition; and introducing the a new classification of the international crimes. The author studied the substance and definition of the international criminal law and suggested that its structure should include the following elements: the international criminal law stricto sensu and transnational criminal law. The evolution of the definition of an extradition crime and political crime in extradition context was analyzed. The doctrinal and practical aspects of non-surrender principle applied to those accused of political crimes were approached in the dissertation. The international legal definition of the transnational crime was developed; the conventional notion of the transnational organized crime and international standards of certain offences criminalization were examined. The author analyzed the international legal interpretation of terrorism and its proposed definitions. Suggestions were made with regard to ensuring effectiveness of the international cooperation in crime fighting.
